Powers of Arrest - Proposed Changes to the Criminal Code of Canada

Much has been talked about regarding the amendment to deal with sections of the Criminal Code that address self defence and the power of an ordinary citizen to make a lawful arrest. Mr. Goldstein will present the case of David Chen, a Toronto grocer who made headlines when he detained a shoplifter and the resulting proposed criminal code changes.
Bill C-60 was introduced by the Federal Government to amend Criminal Code section 494(2) “to prevent incidents like Mr. Chen’s from occurring again.” The proposed amendment will permit property owners, tenants, property managers, security guards, loss prevention officers, etc. (the “Property Owner”) to arrest a person without a warrant if they find them committing a criminal offence on or in relation to that property either “immediately”, OR “reasonably” later but only if the person making the arrest believes on reasonable grounds that it is not feasible in the circumstances for a peace officer to make the arrest.

Mr. Goldstein is a renowned expert, lecturer, author and video evidence consultant with a strong understanding of issues faced by providers of security services in Canada.
He is a member in good standing of the Law Society of Upper Canada and has been practicing law in Ontario since 1988. Prior to that he was a member of the Bar of British Columbia since 1984.
